1. Acceptance of Terms
By accessing or using WellBooked, including our website, platform, and related services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you should not use the service.
2. Service Description
WellBooked provides digital tools and services for restaurants, bars, cafes, and hospitality venues, including website and profile management, guest experience tools, reservation management, booking integrations, customer insights, communication features, and related business support services. We may update, improve, or modify the service from time to time.
3. Eligibility and Accounts
To use certain features of the service, you may need to create an account or submit business information. You agree to provide accurate, current, and complete information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
4. Acceptable Use
You agree to use WellBooked only for lawful business purposes and in a manner that does not interfere with the operation, security, or integrity of the service. You must not misuse the platform, attempt unauthorized access, upload harmful code, interfere with other users, or use the service in violation of applicable laws or regulations.
5. Venue Responsibilities
Venues using WellBooked are responsible for the accuracy of the information they publish through the platform, including menus, opening hours, prices, availability, booking rules, and venue details. Venues are also responsible for how they collect, manage, and communicate with guests through the service, including ensuring they have any required legal permissions or notices in place.
6. Reservations and Guest Interactions
WellBooked may support reservations, booking requests, guest messaging, table management, feedback collection, and related workflows. While we provide the tools that enable these interactions, the venue remains responsible for its own booking decisions, service delivery, guest communications, and fulfillment of any offers, policies, or commitments presented to guests.
7. Fees, Billing, and Plan Changes
Certain parts of the service may require payment under a subscription or commercial agreement. By subscribing to a paid plan, you agree to pay the applicable fees and any taxes or charges as described at the time of purchase. Unless otherwise stated, fees are exclusive of VAT. We may change pricing, plan structures, or service features in the future, and we will provide notice where required.
8. No Long-Term Commitment Unless Agreed
Unless otherwise stated in a separate written agreement, use of the service does not require a long-term commitment. Venues may change or cancel plans according to the terms of their subscription arrangement and any applicable billing cycle requirements.
9. Intellectual Property
WellBooked and its related content, software, branding, design, text, graphics, and functionality are owned by or licensed to WellBooked and are protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse engineer, or exploit any part of the service except as expressly permitted.
10. User Content and Venue Materials
You retain ownership of the content you provide to WellBooked, such as venue descriptions, menus, photos, branding materials, and other business information. By submitting or publishing this content through the service, you grant WellBooked the rights necessary to host, display, process, and use that content for the purpose of operating and improving the platform.
11. Availability and Service Changes
We work to keep WellBooked available and reliable, but we do not guarantee uninterrupted or error-free access at all times. We may suspend, limit, or modify parts of the service for maintenance, updates, security reasons, legal requirements, or operational improvements.
12. Disclaimers
WellBooked is provided on an "as is" and "as available" basis to the extent permitted by law. While we aim to provide reliable and useful tools, we do not guarantee specific business outcomes such as increased bookings, improved occupancy, or revenue growth.
13. Limitation of Liability
To the maximum extent permitted by law, WellBooked will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising from or related to the use of the service. Our total liability for claims relating to the service will be limited to the amount paid by you to WellBooked for the applicable service period, where permitted by law.
14. Termination
We may suspend or terminate access to the service if you violate these Terms, misuse the platform, fail to pay applicable fees, or create risk for the platform, other users, or third parties. You may also stop using the service or cancel your plan in accordance with your subscription terms.
15. Privacy
Your use of the service is also subject to our Privacy Policy, which explains how we collect, use, and protect personal and business information.
16. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in the platform, legal requirements, or business practices. When we do, we will update the "Last Updated" date and may provide additional notice where appropriate.
